Bibb County, Macon GA | Effective June 17, 2024: Maximum Rate Tariff No. 5 for Non-Consensual Towing

https://dps.georgia.gov/effect...On June 13, 2024, the Board of Public Safety voted upon and approved the adoption of Georgia Department of Public Safety Maximum Rate Tariff No. 5 pertaining to Intrastate Rates and Charges for Non-Consensual Towing to be effective beginning June 17, 2024.

This tariff governs rates, fares, and charges for services related to the removal and storage for towing of trespassing vehicles on private property when towing is performed without the prior consent or authorization of the owner or operator of the vehicle.

This tariff is authorized by O.C.G.A. § 44-1-13 and governed by Georgia Department of Public Safety Rules and Regulations Chapter 570-38-7.

Georgia Law regulates the towing of vehicles, including non-consensual towing and the towing of abandoned vehicles. 

Non-consensual towing, wrecker services, and towing companies must have a non-consensual towing permit to tow vehicles without the owner's consent. Towing companies must maintain commercial insurance and provide reasonable access to towed vehicles. Towing companies must equip their vehicle with a valid license plate, fire extinguisher, stopped vehicle warning device, and tow-away lamps. The Department of Public Safety can assess penalties for violations. 

Abandoned vehicles: Proceeds from the sale of abandoned vehicles are paid into a general fund of the county or municipality where the sale took place.
